These Terms and Conditions of Sale are entered into, on the one hand, by MBTJM (for the TRICOTS JEAN MARC brand), a company with a share capital of €10,000, whose registered office is located in Clamart, registered with the Nanterre Trade and Companies Register under number 808 641 435, hereinafter referred to as “TRICOTS JEAN MARC,” which operates the website www.tricotsjeanmarc.fr, and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.tricotsjeanmarc.fr, hereinafter referred to as “the buyer.”

 

Article 1. Purpose

The purpose of these Terms and Conditions of Sale is to define the contractual relationship between TRICOTS JEAN MARC and the buyer, as well as the terms applicable to any purchase made through the website www.tricotsjeanmarc.fr.
The purchase of a product through this website implies the buyer’s unconditional acceptance of these terms and conditions of sale, which the buyer acknowledges having read prior to placing an order.
Prior to any transaction, the buyer declares that the purchase made on the website www.tricotsjeanmarc.fr is for strictly personal use, with no direct connection to a professional activity, and that the buyer has full legal capacity to enter into an agreement under these general terms and conditions of sale.

TRICOTS JEAN MARC reserves the right to modify these terms and conditions at any time to comply with any new regulations or to improve the use of the website. The applicable terms and conditions are those in effect on the date of the order.

 

Article 2. Products

The products offered are those listed on the website www.tricotsjeanmarc.fr operated by TRICOTS JEAN MARC, subject to availability. TRICOTS JEAN MARC reserves the right to modify the product selection at any time. Each product is presented on the website with a description detailing its main technical specifications (material, size, color). The photographs are as accurate as possible but are not binding on the Seller. The sale of products presented on the website www.tricotsjeanmarc.fr is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

 

Article 3. Prices

The prices listed on the product pages are in euros (€), inclusive of all taxes (TTC), including the VAT rate applicable on the date of the order. Any change in the VAT rate may be reflected in the prices.

Orders must be paid for in euros and online. Any bank fees associated with the payment are the responsibility of the buyer.

The goods remain the property of TRICOTS JEAN MARC until full payment has been received.

TRICOTS JEAN MARC may modify its prices at any time; however, the applicable price is the one in effect on the date of the order.

Prices do not include shipping costs, which are billed as an additional charge based on the order amount and destination.

In mainland France and Belgium:
Shipping rates to mainland France and Belgium:
• €4: Colissimo pickup at a pickup point for orders under €75
Estimated delivery time: 4 to 5 business days
• €6: Colissimo to a pickup point for orders between €75 and €200
Estimated delivery time: 4 to 5 business days
• €6: Colissimo home delivery for orders under €75
Estimated delivery time: 2 to 3 business days
• €9: Colissimo home delivery for orders between €75 and €200
Estimated delivery time: 2 to 3 business days

Shipping is free for orders of €200 or more for all orders shipped to mainland France and Belgium.

For all other destinations, the applicable shipping costs will be indicated when placing the order.

 

Article 4. Order and payment terms

Items are available while supplies last. If an item is unavailable after payment has been processed, TRICOTS JEAN MARC will offer an exchange or a refund and notify the customer by email.

TRICOTS JEAN MARC reserves the right to cancel any order in the event of a dispute regarding a previous order or a payment error.

Ordering process:
1_ The buyer selects the product(s) and specifications (model, size, color).
2_ The buyer adds the item(s) to the cart and can modify the order before payment.
3_ The buyer enters their email address, delivery method (pickup point, home delivery, in-store pickup), and shipping address.
4_ The buyer selects a secure payment method (credit card or PayPal).
Credit card payment: The buyer enters their card information and confirms.
• PayPal payment: The buyer is redirected to the secure PayPal interface to enter their login credentials.
Payment is final. In the event of fraudulent use, the buyer may dispute the transaction with their bank within the legal time limits.

Order confirmation constitutes acceptance of these Terms and Conditions and serves as proof of the transaction.

Article 5. Retention of title

TRICOTS JEAN MARC retains ownership of the products until full payment has been received.

 

Article 6. Cancellation

In accordance with Article L121-20 of the French Consumer Code, the buyer has 14 days from the date of delivery to exercise their right of withdrawal and return the product for an exchange or refund without penalty, except for return shipping costs, which remain the buyer’s responsibility.

All returns must be made in the original packaging, in perfect condition, unworn, and unwashed.

In the event of withdrawal, TRICOTS JEAN MARC will refund the customer within 14 days of notification, subject to receipt or proof of return of the product. The refund will be issued via the original payment method, unless otherwise agreed.

No refund will be issued if the product has been damaged due to handling other than that necessary to verify its nature and conformity.

 

Article 7. Shipping

Products are shipped via Colissimo, at the Buyer’s discretion:
• To a Colissimo pickup point
• To your home (with or without a signature)

Shipping costs are automatically calculated when the order is confirmed, based on the destination and the total weight of the products.
Shipping is free for orders of €200 or more for all orders shipped to mainland France and Belgium.

For orders under this amount, shipping costs are as follows:

• Colissimo Pickup Point:
  • €4 for orders under €75 (estimated delivery time: 4 to 5 business days);
    
  • €6 for orders between €75 and €200 (delivery time: 4 to 5 business days).
    
• Colissimo home delivery
  • €6 for orders under €75 (delivery time: 2 to 3 business days)
  • €9 for orders between €75 and €200 (delivery time: 2 to 3 business days).

MBTJM undertakes to ship the products within a reasonable time after the order is confirmed. Delivery times are provided for informational purposes only and do not constitute a guarantee of delivery.

In the event of a delivery delay not attributable to MBTJM, MBTJM shall not be held liable. If the package is not received within the indicated time frame, the Buyer is asked to contact customer service at info@tricotsjeanmarc.com.

 

Article 8. Guarantee

The products are covered by the legal warranty provided for in Articles 1641 et seq. of the Civil Code.

In the event of non-conformity, the customer may return the product for an exchange or refund within 14 days by email (info@tricotsjeanmarc.com) or by mail to:

Article 9. Liability

TRICOTS JEAN MARC is bound by an obligation of means in the context of distance selling. It shall not be held liable for any damages resulting from the use of the Internet (loss of data, viruses, service interruptions, etc.).

 

Article 10. Intellectual Property

All content on the www.tricotsjeanmarc.fr website is the exclusive property of TRICOTS JEAN MARC. Any reproduction or use, even partial, without authorization is prohibited.
